2010 Consignment Auction Terms and Conditions

LOCATION: Morrow County Fairgrounds, Mt Gilead, Ohio
AUCTIONS: WINTER- last Saturday of February each year
SUMMER- First Saturday in August each year( held in
conjunction with the Morrow Co. Farm Days Celebration)
TERMS AND CONDITIONS:
1. Auction will be held reguardless of weather conditions.
2. All consignments must be checked in and tagged immediately upon arrival on the fairgrounds.
3.Consignors must supply a description of their consignmnets along with name , address and phone# and sign a Consignment Conrol Form, that gives the right to sell all said property - having good title and free from all incumbrances.
4. Loader equipment will be available to unload and load consignments. Items should be removed as soon as possible after Auction is completed.
5.CONSIGNMENT RATES:
$ 1- 200 **************20%
$200-1000***********10%
$1001 - 3000 *********8%
$ 3001 - UP*********** 6%
6. Consignments rates are charged per consignor NOT per item. Items not sold will be charged a $30 fee.
7. Auctioneers reserve the right to settle ALL transactions , especially consignments that are NOT respresented correctly and honestly.
8. Auctioneers and staff are NOT responsible for accidents or stolen/damaged items.
9. Settlement checks will be mailed within 10-15 days following the Auction. Auctioneers will aide in collecting bad checks if that situation arrises.
10. Auctioneers are bonded( Auction Recovery Fund 4707.25) and licensed in favor of the State of Ohio, Ohio Agriculture Dept.
11. Absentee bidders are required to register their name, address,phone#,ID and state in writing their bid.The Auctioneer and his staff and registered absentee bidders may participate in the auction. The Auctioneer acts as a dual sgent in these instances.
12. Item or items consigned will be sold as either a Reserve or Absolute type of sale.
Reserve: an auction in which the seller or agent of the seller, reserves the right to establish a stated minimum bid, the right to accept or reject any or all bids, or the right to withdraw the property prior to the completion of the auction by the auctioneer.
Absoulte: (a) property is sold to the highest bidder without reserve(b)does not require a min-imum bid(c)does not require competing bids of any type by seller or agent of seller(d)seller cannot withdraw property from the auction after the auction is opened and public solicitation of bids.
13. No tires will be accepted unless they are on rims and are screened by the staff.
14. ONLY farm related items- NO household. The Auctioneers and staff have the right to screen consignment items before they are tagged in to qualify for the Auction.
